General Information

The following information provides a simple overview of what happens to your personal data when you visit this website. Personal data is any data that can be used to identify you personally. More detailed information is provided below.

Data Collection on This Website

Who is responsible for collecting data on this website?

Data processing on this website is carried out by the website operator. The operator's contact details are listed in the section "Controller responsible for data processing."

How do we collect your data?

Some data is collected when you provide it to us, for example when you enter information in a contact or appointment request form.

Other data may be collected automatically by our IT systems when you visit the website, or after you have given your consent. This mainly includes technical data, such as your browser, operating system, or the time at which a page was accessed.

What do we use your data for?

Some data is collected to ensure that the website can be provided without errors. Other data may be used to understand how visitors use the website.

What rights do you have regarding your data?

You have the right to receive information, free of charge, about the origin, recipients, and purpose of your stored personal data at any time. You also have the right to request correction or deletion of this data. If you have consented to data processing, you may withdraw that consent at any time for the future. You may also have the right to request restriction of processing in certain circumstances and to lodge a complaint with the competent supervisory authority.

2. General Information and Mandatory Disclosures

Data Protection

The operator of this website takes the protection of your personal data seriously. We treat your personal data confidentially and in accordance with applicable data protection law and this privacy policy.

When you use this website, various types of personal data may be collected. This policy explains what data we collect, how we use it, and for what purpose.

Please note that data transmission over the internet, for example by email, may have security vulnerabilities. Complete protection against access by third parties cannot be guaranteed.

Controller Responsible for Data Processing

The controller responsible for data processing on this website is:

Dr. med. univ. Thomas Wendel
Franz Joseph Str 20
80801 München
Germany

Email: office@dr-wendel.med

The controller is the natural or legal person who alone or jointly with others determines the purposes and means of processing personal data, such as names or email addresses.

Retention Period

Unless a more specific retention period is stated in this privacy policy, your personal data will remain with us until the purpose for processing it no longer applies. If you make a valid deletion request or withdraw consent to processing, your data will be deleted unless we have other legally permissible reasons for storing it, such as tax or commercial retention obligations. In that case, deletion takes place once those reasons no longer apply.

Legal Bases for Data Processing

Where you have consented to processing, we process your personal data on the basis of Art. 6(1)(a) GDPR or, where special categories of data are processed, Art. 9(2)(a) GDPR. If you have expressly consented to the transfer of personal data to third countries, processing is also based on Art. 49(1)(a) GDPR. Where you have consented to cookies being stored or to access to information on your device, processing is also based on applicable telecommunications privacy law. Consent can be withdrawn at any time.

If your data is required for performance of a contract or pre-contractual measures, we process it on the basis of Art. 6(1)(b) GDPR. If processing is necessary to comply with a legal obligation, processing is based on Art. 6(1)(c) GDPR. Processing may also be based on our legitimate interests under Art. 6(1)(f) GDPR. The relevant legal basis for each case is described in this policy where applicable.

We have appointed a data protection officer:

Withdrawal of Consent

Many data processing operations are only possible with your express consent. You may withdraw consent you have already given at any time. The lawfulness of processing carried out before withdrawal remains unaffected.

Right to Object to Processing and Direct Marketing

If data is processed on the basis of Art. 6(1)(e) or Art. 6(1)(f) GDPR, you have the right at any time, on grounds relating to your particular situation, to object to the processing of your personal data. This also applies to profiling based on those provisions. If you object, we will no longer process the affected personal data unless we can demonstrate compelling legitimate grounds for processing that override your interests, rights, and freedoms, or unless processing serves the establishment, exercise, or defense of legal claims.

If your personal data is processed for direct marketing, you have the right to object at any time to processing for that purpose. This also applies to profiling connected with direct marketing. If you object, your personal data will no longer be used for direct marketing.

Right to Lodge a Complaint

If the GDPR has been infringed, data subjects have the right to lodge a complaint with a supervisory authority, particularly in the EU member state of their habitual residence, place of work, or the place of the alleged infringement. This right exists without prejudice to any other administrative or judicial remedies.

Right to Data Portability

You have the right to receive data that we process automatically on the basis of your consent or in performance of a contract in a commonly used, machine-readable format, or to have it transferred to a third party. Direct transfer to another controller will only take place where technically feasible.

Access, Correction, and Deletion

Within the scope of applicable law, you have the right at any time to receive information free of charge about your stored personal data, its origin and recipients, and the purpose of processing. You may also have the right to request correction or deletion of this data.

Right to Restriction of Processing

You have the right to request restriction of processing in the following cases:

  • If you dispute the accuracy of personal data stored by us, we usually need time to verify this. During that review period, you may request restriction of processing.
  • If processing is unlawful, you may request restriction of processing instead of deletion.
  • If we no longer need your personal data but you need it for the establishment, exercise, or defense of legal claims, you may request restriction of processing instead of deletion.
  • If you have objected under Art. 21(1) GDPR, a balance must be struck between your interests and ours. Until it is clear whose interests prevail, you may request restriction of processing.

Where processing has been restricted, the data may, apart from storage, only be processed with your consent, for legal claims, to protect the rights of another person or legal entity, or for important public interest reasons of the European Union or an EU member state.

Contact and Appointment Forms

If you send us inquiries through a contact or appointment request form, the information you provide, including your contact details, is stored and processed for the purpose of handling your inquiry and any follow-up questions. We do not share this data without your consent.

Processing is based on Art. 6(1)(b) GDPR where your inquiry relates to performance of a contract or pre-contractual measures. In all other cases, processing is based on our legitimate interest in effectively handling inquiries addressed to us under Art. 6(1)(f) GDPR, or on your consent under Art. 6(1)(a) GDPR where consent has been requested. Consent may be withdrawn at any time.

Data entered in forms remains with us until you ask us to delete it, withdraw consent to storage, or the purpose for storing the data no longer applies, for example after your inquiry has been fully handled. Mandatory legal provisions, especially retention periods, remain unaffected.

Inquiries by Email or Telephone

If you contact us by email or telephone, your inquiry and the personal data arising from it, such as your name and the content of your inquiry, will be stored and processed for the purpose of handling your request. We do not share this data without your consent.

Processing is based on Art. 6(1)(b) GDPR where your inquiry relates to performance of a contract or pre-contractual measures. Otherwise, processing is based on our legitimate interest in effectively handling inquiries addressed to us under Art. 6(1)(f) GDPR, or on your consent under Art. 6(1)(a) GDPR where consent has been requested. Consent may be withdrawn at any time.

Data sent to us through contact inquiries remains with us until you ask us to delete it, withdraw consent to storage, or the purpose for storing the data no longer applies, for example after your matter has been fully handled. Mandatory legal provisions, especially statutory retention periods, remain unaffected.
